Step-by-Step Checks for Sunlight Income Projects ①: Policy Status and Early Legal Issues

With energy demand surging and rural communities facing depopulation, "Sunlight Income Villages" (햇빛소득마을), which generate solar power on idle land and share the income with residents, are emerging as a realistic alternative. Attorney Sungwoo (Goni) Kim of SOLARIS contributed a column to a major outlet on the early legal issues facing rural solar projects and practical ways to resolve them.

The column sets out the key questions to check at the outset so that a power project running for 20 years or more can settle on a stable footing.

  • (Income sharing) Residents need to agree on what "sunlight income" means, and the cooperative's articles should clearly set out essential operating expenses and the ratio for distributing profits.

  • (Eligibility) Who counts as a resident, and therefore holds rights and obligations, should be fixed using objectively verifiable criteria such as length of actual residence and attendance at village general meetings.

  • (Joint projects) When a project is pursued together with neighboring villages, the parties should sign an agreement that clearly governs how equity is valued and how liability is allocated, to prevent disputes.

SOLARIS diagnoses the complex legal issues that arise in energy transition projects and helps project owners operate stably by designing bylaws and governance structures tailored to each village and project.
