With solar modules in short supply worldwide, more and more power plant construction sites are coming to a standstill. Against this backdrop, Attorney Sungwoo (Goni) Kim of SOLARIS published a column in a major outlet examining the legal issues facing contractors and power producers. The publication devoted space to the column in recognition of SOLARIS's expertise in renewable energy contract practice and regulatory trends.

Attorney Kim addressed three key points. First, if module deliveries are delayed, the contractor bears contractual liability for late performance, and courts are unlikely to accept higher material prices alone as force majeure. Second, the contractor can pursue the module supplier that delays delivery, but litigation takes a long time and does little to solve the immediate problem of a halted project. Third, rather than focusing on litigation, it is more realistic for the parties to agree on a reasonable extension of the construction period and a sharing of costs. Future contracts should also include clauses that flexibly reflect changes in material prices.
